1. WHEN THIS PRIVACY STATEMENT APPLIES.

This Privacy Statement (“Statement”) describes the information that we gather from you in connection with our Service Offerings (“Services”), how we use and disclose such information, the steps we take to protect such information, and how you can exercise your data protection rights.

This privacy policy discloses the privacy practices for ProAdvisor CPA’s website, www.proadvisorcpa.com. This online privacy policy applies only to information collected through our website and not to information collected offline.

2. WHAT WE DO WITH YOUR INFORMATION.

We want to be clear about what information we collect and how we use it to deliver our Services to you, operate our business, and help make our Services work better for you. We do not sell or share your Personal Information with third parties for their own commercial uses without your consent.

a) Types of Information We Collect.

ProAdvisor CPA is the sole owner of the information collected on this site. We have access to/collect information that you voluntarily give us via email or other direct contact from you.

We collect information from you when you subscribe to our newsletters, alerts, respond to a survey, fill out a contact form, register for an event, or submit resumes.

When registering on our site, as appropriate, you may be asked to enter your name, title, company name, e-mail address, mailing address, and/or phone number. You may, however, visit our site anonymously.

In connection with accessing our Services, we may collect information from you which can be used to identify you (“Personal Information”), such as your name, billing address, email address, phone, username, password, and financial data.

We collect information when you register or open an account, sign in, pay a bill, purchase a Service, call us for support, or give us feedback. We may also get information from other companies or third parties, such as when you sync a third party account or service with your Service, or when we may use service providers to supplement the Personal Information you give us (e.g., validate your mailing address) to help us maintain the accuracy of your data and provide you with better service. Finally, we also collect content or other information that you may provide or create when you interact with our Services.

We may also automatically collect certain usage information when you access our Services (“Usage Data”), such as Internet Protocol (“IP”) addresses, log files, unique device identifiers, pages viewed, browser type, and any links you click on to leave or interact with our Services, and other usage information collected from cookies and other tracking technologies. For example, we may collect IP addresses to track and aggregate non-personal information, such as using IP addresses to monitor the regions from which users navigate to our Services. We may also collect IP addresses from users when they log into the Services as part of our log-in and security features. We may also, when you enable location-based Services, collect Global Positioning System (GPS) location data and/or motion data


Our Services may change over time and we may introduce new features that may collect new or different types of information.

b) How We Use Your Information.

Any of the information we collect from you may be used to send periodic emails, register you for events, add you to our newsletter mailing lists, send you information, respond to inquiries, and/or other requests or questions.

From time to time our site requests information via surveys. Participation in these surveys is completely voluntary and you may choose whether or not to participate and therefore disclose this information. Information requested may include contact information (such as name, email, and address), and demographic information (such as zip code, age level, and industry type). Survey information will be used for purposes of monitoring or improving the use and satisfaction of our services or to gather information for measuring key performance indicators in a variety of industry sectors.

We may use your information, including your Personal Information, for the following purposes:

Account Registration. We may use your name, address, phone number, and email address to register your account for certain Services we provide and to communicate important information to you. We may obtain additional Personal Information about you, such as address change information, from commercially available sources, to keep our records current. If you set up an account that may be accessed by people other than you, please note that they may see and have the ability to change or delete your Personal Information.

To Provide Our Services and Operate Our Business. We may use your information to operate our business, including providing the Services you requested, providing you with support related to our Services, and helping us protect our Services, including to combat fraud and protect your information.

Customer Service and Technical Support. We may use your name, address, phone number, email address, how you interact with our Services, and information about your computer configuration to resolve questions you may have about our Services and to follow up with you about your experience. We may also offer various Internet chat services, for example, speaking with a support representative. Internet Chat transmissions are encrypted but you should not supply more Personal Information, including tax data than is required to address your specific issue. A transcript of the session may be retained to resolve questions or issues related to our Services.

Communicate with You and Tell You About Other Services. We may use your information to communicate with you about our Services and to give you offers for third-party products and services that we think may be of use to you. Please see below under “What You Can Do to Manage Your Privacy” for the choices you have regarding these communications.

To Improve Services and Develop New Services. We will use your information to personalize or customize your experience and the Service, develop new features or services, and improve the overall quality of our Services.

Feedback. We may use any information you volunteer in surveys you answer for us and combine them with answers from other customers in order to better understand our Services and how we may improve them. Answering any survey is optional.

Research, Including Publishing or Sharing Combined Information from Many Users, But Only in a Way that Would Not Allow You or Any Other Person to be Identified. Only in a way that would not allow you or any other person to be identified, we may prepare and share information about our customers with third parties, such as advertisers or partners, for research, academic, marketing and/or promotional purposes. For example, we may share demographic data that describes the percentage of our customers who use mobile services or who use a particular operating system. We or our third-party partners may publicly report the aggregated findings of the research or analysis, but only in a way that would not allow you or any other person to be identified.

c) How We Share Your Personal Information.

From time to time, we may need to share your Personal Information with others. We may only release your information to third parties when we believe release is appropriate to comply with the law, when explicitly requested by you as a visitor to our site, to deliver requested publications or information and when required to register for events, roundtables, or conferences hosted by a third party.

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information.

Third-Party Service Providers. We may share your information, including Personal Information and Usage Data, with third-party service providers who perform various functions to enable us to provide our Services and help us operate our business, such as website design, sending email communications, fraud detection, and prevention, customer care, or performing analytics. Our contracts with these third parties require them to maintain the confidentiality of the Personal Information we provide to them, only act on our behalf and under our instructions, and not use Personal Information for purposes other than the product or service they’re providing to us or on our behalf.

Response to Subpoenas and Other Legal Requests. We may share your information with courts, law enforcement agencies, or other government bodies when we have a good faith belief we’re required or permitted to do so by law, including to meet national security or law enforcement requirements, to protect our company, or to respond to a court order, subpoena, search warrant, or other law enforcement request.

Protection of ProAdvisor CPA and Others. We may share account information, Personal Information, and Usage Data when we believe it is appropriate to enforce or apply our products’ Terms of Service and other agreements; or protect the rights, property, or safety of us, our Services, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. This does not include selling, renting, sharing, or otherwise disclosing Personal Information of our customers for commercial purposes in violation of the commitments set forth in this Privacy Statement.

Reporting to Credit Bureaus. We may share your information with credit bureaus, consumer reporting agencies, and card associations. Late payments, missed payments, or other defaults on your account may be reflected in your credit report and consumer report. We may also share your information with other companies, lawyers, credit bureaus, agents, government agencies, and card associations in connection with issues related to fraud, credit, or debt collection.

Sale of Our Business. If we sell, merge, or transfer any part of our business, we may be required to share your information. If so, you will be asked if you’d like to stop receiving promotional information following any change of control.

With your Consent. Other than as set out above, we will provide you with notice and the opportunity to choose when your Personal Information may be shared with other third parties.

d) Syncing, Linking, Connecting Your Bank Account or Other Third Party Services with ProAdvisor CPA Service(s).

You may choose to sync certain Services with information from other financial accounts. To sync your financial account information, we must access your online account with your financial institution. We will request your user name, password, and any other login data that you have set up with your financial institution to enable access. We use this information to update and maintain the account information you download, to assist with the download process, and to enhance the Services we may provide in the future.

We work with other companies or developers to offer you products and services and you may choose to sync, link or connect other third-party services with our Service. Sometimes we may let you know about the service or product, or another company may let you know about a service or product. It will be clear who is referring to the service or product, and who is providing the service or product. If you choose to accept these services, providing your consent to either the third party or to us, we may exchange your information, including your Personal Information, as well as information about how you interact with each company’s service or product. This exchange of information is necessary to maintain business operations and to provide the ongoing service you’ve requested. By requesting or accepting these products or services, you are permitting us to provide your information, including your Personal Information, to the other party.

One company we work with is Plaid. You hereby consent to give Plaid the right, power, and authority to act on your behalf to access and transmit to us information from your synced financial accounts. You acknowledge and agree that such information will be treated by Plaid in accordance with Plaid’s privacy policy, which is available at: https://plaid.com/legal/#Privacy-Policy.

3. WHAT YOU CAN DO TO MANAGE YOUR PRIVACY.

You can view and edit the information that identifies you online through our Services. How you can access and control information that identifies you will depend on which Services you use. You have a choice about the use of information that identifies you, marketing communications you receive from us, and our use of cookies and other tracking technologies.

a) Updating Your Personal Information.

In connection with your right to manage the Personal Information you provide to us, you may access, update, change, correct or request deletion of your information either through the Service or through our customer support. You can reach our customer support by using the contact information provided in the “How to Contact Us” section of this statement.

b) Managing Marketing Communications From Us.

We will honor your choices when it comes to receiving marketing communications from us. Remember that even if you choose not to receive marketing communications from us, we will continue to send you mandatory service or transactional communications.

c) Cookies and Other Tracking Technologies.

The following is a high-level summary of our practices and your controls for cookies and other tracking technologies.

In accordance with applicable law, we and our service providers may use commonly-used tools to recognize your visit and track your interactions with our Services such as cookies, web beacons, pixels, local shared objects, and similar technologies (collectively, “Cookies”). Sometimes this tracking is necessary in order for us to provide you the Service you requested. Other times, we combine Usage Data collected from Cookies with that of other customers to improve your and other customers’ experience. You have control over some of the Usage Data we collect from Cookies and how we use it. Information on changing your browser settings to opt out of Cookies can be found in your browser settings. If you opt out and later delete your Cookies, use a different browser, or buy a new computer, you may need to renew your opt-out choices.

We use cookies to compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

d) Do Not Track.

Like most other companies, our Services are not currently configured to respond to browsers’ “Do Not Track” signals because at this time no formal “Do Not Track” standard has been adopted.

e) Social Media Features and Single Sign-On.

Our Services may use social media features, such as Facebook sharing (“Social Media Features”). These features may collect your IP address and which page you are visiting within our Service, and may set a cookie to enable the feature to function properly. Social Media Features are either hosted by a third party or hosted directly on our Services. Your interactions with these features are governed by the privacy statement of the company providing the relevant Social Media Features. If you are a member of a social media site(s) that ProAdvisor CPA is also a member of, you should be aware that the profile you created, which may include personal information, (such as your gender, age, occupation, and place of work) may be accessed and viewed by other members of that social media site, including (and certainly not limited to) other ProAdvisor CPA clients. As such these communications should be courteous, and professional and should not expose your personal information unnecessarily. ProAdvisor CPA participates in these social media sites for the purpose of promoting discussion and fostering knowledge about ProAdvisor CPA. These social media sites are provided by third-party vendors, and while we participate in these social media venues we do not have any control and cannot be held responsible for their content.

We may use social media features, such as the Facebook “like” button (“Social Media Features”). These features may collect your IP address and which page you are visiting on our website, and may set a cookie or other similar technologies to enable the feature to function properly. You may be given the option by such Social Media Features to post information about your activities on our Offering to a profile page of yours that is provided by a third-party social media network in order to share with others within your network. Social Media Features are either hosted by a third party or hosted directly on our Offerings. Information collected in the context of the Social Media Features is subject to the relevant social media platforms’ own data collection, use, and disclosure policies. We may also allow you to log in to specific areas of our Offerings using sign-in services provided by social media platforms. These services authenticate your identity and may provide you the option to share certain personal information with us such as your name and email address to pre-populate our sign-up form.

4. DATA RETENTION AND YOUR ACCESS RIGHTS

a) Data Retention.

In accordance with and as permitted by applicable law and regulations, we will retain your information as long as necessary to serve you, to maintain your account for as long as your account is active, or as otherwise needed to operate our business. When you close your account, we may continue to communicate with you about our Services, give you important business updates that may affect you, and let you know about products and services that may interest you, unless you have opted out of receiving marketing communications. We may also continue to use some of your information for business purposes and to improve our offerings or in some cases to develop new ones. We will retain and use your information as required by applicable regulations and our records and information management policies to comply with our legal and reporting obligations, resolve disputes, enforce our agreements, complete any outstanding transactions, and for the detection and prevention of fraud.

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives, then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Although we may keep records as part of our service agreement with you, it is ultimately your responsibility and you understand that you are responsible for your own record keeping and data retention.

b) Your Access Rights.

As required by applicable law, you may contact us to confirm whether we maintain, or process on behalf of a third party, any of your Personal Information and to review it in order to verify its accuracy and the lawfulness of our processing of such Personal Information. Where you have determined that the Personal Information we collected about you is inaccurate or processed in violation of applicable law, you may also request that your Personal Information be corrected, amended, or deleted. Requests for access to your Personal Information and to have it corrected, amended, or deleted should be sent to support@proadvisorcpa.com.

5. SECURITY OF YOUR INFORMATION.

Keeping your Information safe is important to us. We implement a variety of security measures to maintain the safety of your personal information when you enter and submit your personal information. At ProAdvisor CPA, security is a priority. We follow security framework practices based on leading industry standards. We use physical, managerial, and technical safeguards that are designed to improve the integrity and security of information that we collect, process, and maintain. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. Security is an evolving area and we are constantly working to not only raise the level of security it deploys but also the security training of its employees.

Please be aware that no security measures are perfect or impenetrable. We cannot and do not guarantee that your information will not be accessed, viewed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

While we use SSL encryption to protect sensitive information transmitted via the online portal, we also protect your information offline. As certified public accountants, we are required by our code of ethics (AICPA Rule 301 and Circular 230 by the Internal Revenue Code) and by state regulation (Rule 54) to maintain the confidentiality of information obtained from and regarding our clients. Only ProAdvisor CPA personnel are provided access to personally identifiable information and these employees have agreed to ensure confidentiality of this information and to adhere to ProAdvisor CPA’s network security policy.

Occasionally, at our discretion, we may include links to third-party websites. These third-party sites have separate and independent privacy policies. We, therefore, have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites. We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which links or access are provided through our Services. We encourage you to learn about third parties’ privacy and security policies before providing them with information.

We provide reasonable and appropriate security measures in connection with securing the Personal Information we collect.

For example, we:

  1. Constantly work to update our security practices to implement accepted best methods to protect your Personal Information, and review our security procedures carefully.
  2. Comply with applicable laws and security standards.
  3. Securely transmit your sensitive Personal Information.
  4. Train our staff and require them to safeguard your data.
  5. Transmit, store, protect, and access all cardholder information in compliance with the Payment Card Industry’s Data Security Standards.

6. INTERNATIONAL DATA TRANSFERS.

In accordance with and as permitted by applicable law and regulations, we reserve the right to transfer your information, process, and store it outside your country of residence to wherever we or our third-party service providers operate.

a) EEA Rights

If you are a visitor/customer located in the European Economic Area (“EEA”), we are the data controller of your personal information. Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it. However, we will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal information from you.

You have the following rights:

  • You can object to the processing of your personal information, ask us to restrict the processing of your personal information or request portability of your personal information.

If we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

7. COLLECTION AND USE OF CHILDREN’S PERSONAL INFORMATION.

We do not knowingly collect information from minors. Our services are intended for and directed to adults and children over the age of 16 years old. . Our Services are not directed to minors under the age of 16 years old and we do not knowingly collect Personal Information from minors without obtaining parental/guardian consent. If you believe we have collected information belonging to an individual under the age of 16, please let us know by contacting us.

8. YOUR CALIFORNIA PRIVACY RIGHTS.

We do not share your Personal Information with third parties for their marketing purposes without your consent.

a) Shine the Light Customer Rights

Residents of California have the right to request a disclosure describing what types of personal information we have shared with third parties for their direct marketing purposes, and with whom we have shared it, during the preceding calendar year. You may request a copy of that disclosure by contacting us.

b) California Consumer Rights Under The CCPA

The following disclosures apply only to California residents covered under the California Consumer Privacy Act (“CCPA”).

c) Personal information collected for a business purpose and for a commercial purpose.

The purposes for which we collect your personal information are described under the heading “ Types of Information We Collect” above. This section describes the business purposes and commercial purposes for which we collect personal information.

d) Personal information disclosed for a business purpose

This Privacy Notice describes the categories of personal information that we have, disclosed for a business purpose and sold over the preceding twelve (12) months. Please refer to the sections headed “ Types of Information We Collect” and “How We Share Your Personal Information” for more information.

e) Personal information sold

We do not and will not sell your personal information to any other business or third party. We will always seek your affirmative direction/consent to intentionally disclose personal information to third parties in ways that might otherwise be construed to be a “sale” under the CCPA.

f) Right to know and right to delete

You have the right to request that we disclose the personal information we collect, use, disclose and sell. To exercise this right, please follow the instructions described to access your information in the “Your Rights and Choices” section above
